Official Contest Rules

Photo Contest Official Rules - Jan. 4 - Feb. 11 2022

NO PURCHASE NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

1.  Contest Period

The contest entry period (the “Entry Period”) begins at 12:00 AM Pacific Standard Time (“PST”) on January 4, 2022 and ends at 11:59PM PST on February 11, 2022.

2.  How To Enter

a. No purchase of any kind is necessary to enter the contest.

b. To enter the contest:

c. You may submit only one (1) entry. Additional photos or emails do not constitute additional entries.

d. The Qualicum First Nation Culture Program is not responsible for late, lost, incomplete, illegible, stolen, damaged, deleted or destroyed entries or any other circumstances affecting, disrupting or corrupting the contest in any manner.

e. Entries are void if illegible, incomplete, altered, deleted, or mutilated. 

f. By participating in the contest, you agree to be bound to these Official Contest Rules and to the terms and conditions of the contest.  All entries are subject to verification.

3. Eligibility

a. The contest is open only to legal residents of Canada, excluding Quebec, who have reached the age of majority in the province or territory in which they reside at the time of entry.

b. You are not eligible to enter if you are:

(i) an employee representative or agent of the Qualicum First Nation Culture Program, its advertising or promotional agencies, professional representatives, printing suppliers, licensees or the prize supplier; or

(ii) a member of the immediate family of any of the above persons (i.e. spouse, child, sibling, parent) or a member of the household of any of the above persons.

 

4.  Photo Entries

a. All photographs entered in the Contest must include materials provided from the Qualicum First Nation Culture program.

b. All photographs must be original work, taken by the entrants. 

c. No third party may own or control any materials the photo contains, and the photo must not infringe upon the trademark, copyright, moral rights, intellectual rights, or rights of privacy of any entity or person.

d. All entries are intended for the general public. Entrants are fully responsible for the photographs they submit. The Qualicum First Nation Culture Program will not accept photographic entries that are offensive and reserve the right to disqualify, in their sole discretion, any photographic entries that contain, for example, racist, hateful, sexist, homophobic or inappropriate content.

e. All photographic entries must be submitted electronically as .jpg or .png files emailed to qfnculturekits@shaw.ca.

 

5.  Prize

One (1) prize is available to be won consisting of a cash prize of $50.00 CAD.  

 

a. The winner will be randomly selected by February 14, 2022. The selected entrant will be contacted within ten (10) days of the selection by email. If the selected winner cannot be contacted within that time or does not comply with these Official Contest Rules, the prize will be forfeited and an alternative eligible entry will be selected. 

b. The odds of winning are dependent on the number of eligible entries received.

c. In order to win the prize, the eligible entrant must first correctly answer a mathematical skill testing question administered by e-mail or telephone. Correct replies must be received back no later than 12 a.m. (midnight PST) on February 28, 2022 or the prize will be forfeited and an alternative eligible entry will be selected. 

d. Prize is non-transferable and no cash alternative or substitution of the prize is provided, except that the Qualicum First Nation Culture Program, in its sole discretion, reserves the right to substitute a prize of equal or greater value if the prize is unavailable for any reason.  The prize is provided “as is” without warranty of any kind and must be accepted as awarded. The Qualicum First Nation Culture Program disclaims all warranties including but not limited to implied warranties of merchantability, fitness for a particular purpose or non-infringement.

e. Any applicable taxes are the responsibility of the winner.

f. In order to be declared a winner, the selected potential winner will be required to swear an affidavit indicating eligibility and compliance with these Official Contest Rules.  In the event that the winner has not yet reached the age of 18 years or the age of majority in the winner’s province or territory of residence, then the winner’s parent/legal guardian must sign the affidavit to confirm compliance and consent with these Official Contest Rules and to accept the prize on behalf of the minor, and provide a release and indemnity pursuant to Subsection 6(d) below.

h. Prize Value: The approximate retail value of the prize is $50.00 CDN.

 

6.  Conditions of Participation

By participating in this contest, you agree:

a. to be bound by these Official Contest Rules and the decisions of the Qualicum First Nation Culture Program, whose decisions are final;

b. to the use of your name, likeness, voice, image, recording, photos relevant to the giveaway, video footage and statements in connection with this contest and the promotion and exploitation thereof;

c. that by submitting an entry, you give the Qualicum First Nation Culture Program and its agents the right to publish or broadcast your name, likeness, voice, image, recording, photos relevant to the giveaway, video footage or statements for editorial, promotional, advertising and publicity purposes, without compensation;

d. to release and indemnify and hold harmless the Qualicum First Nation Culture Program, its advertising and promotional agencies, the prize suppliers, and all their respective officers, directors, employees, owners, agents, contractors, representatives, successors and assigns from any liability in connection with or arising out of this contest, the awarding of the prize, the use of any personal information or the use of merchandise purchased in relation to winning a prize.

 

7. Termination

The Qualicum First Nation Culture Program also reserves the right, without prior notice, and at any time, to terminate the contest, in whole or in part or modify, suspend or extend the contest in any way.

 

8. General Provisions

In the event that the Qualicum First Nation Culture Program is prevented from continuing with the contest by an event beyond its control, the Qualicum First Nation Culture Program has the right to modify, suspend, extend or terminate the contest.

The invalidity or unenforceability of any provision of these Official Contest Rules does not affect the validity or enforceability of any other provision.

This contest and these Official Contest Rules are governed by and construed in accordance with the applicable provincial and federal laws. 

 

9. Privacy Notice

Personal information in connection with the contest will be used for the administration of the contest and related purposes.
